Moultonborough Policies

Summary of Membership Policies

  • Member, by executing this agreement does hereby join the CLUB and such membership entitles MEMBER to use the Club’s facilities. MEMBER is entitled to use the facility only and MEMBER shall be required to provide MEMBER’S athletic equipment and clothes. MEMBER will be subject to additional charges for and including but not limited to, the use of tanning beds. MEMBER may also be charged for purchases through the use or their key or account number.

  • MEMBER must present his or her membership card upon entering the CLUB. MEMBER agrees to that MEMBER may be denied accuses to the CLUB without his or her membership card.

  • MEMBER agrees to abide by all membership regulation of the CLUB. MEMBER agrees to comply with stated and customary rules for participation and use of equipment. Unless cancelled as provided in the Agreement, member will be responsible for all payments due and owing under this agreement, even if member does not use the club’s facilities and services. However in the event of death or disability, liability for fees will terminate as of the date of death or disability. If the club becomes temporarily unavailable due to an event such as fire, flood loss of lease or the like we extend members membership privileges for the period the facilities were unavailable.

  • If member violates this agreement and the terms contained therein or any of the rules and regulations for use of the facility the club may suspend member’s right to use the facility until such time as member provides the club with reasonable assurance of compliance. During the period of any such suspension member shall not be entitled to a credit for any prepayment of dues or other fees due to paid pursuant to this membership agreement. In the event member continues to violate the terms of this agreement or the rules and regulations governing the facility, members membership may be terminated by the club and the balance of the contract declared due and payable in full immediately.

  • Member agrees that he/she shall not engage in any type of commercial or business activity while the facilities including acting as a trainer (whether paid or unpaid) for any other club members or guests of any member. Any acts which constitute such business activities are strictly forbidden. If a member engages in such commercial or business activities member’s membership shall be subject to immediate cancellation and the balance of the contract declared due and payable in full immediately.

  • Member agrees that member shall abide by the club dress code at all times in the facility. Member agrees not to wear blue jeans or any pants/shorts that have blue jean type seams or rivets. Flip-flops or bare feet are not allowed in the club.

  • Member agrees that member shall not use loud or profane language upon the club premises nor shall member molest, badger, assault or harass other club members, guests or employees. If member engages in such behavior, member’s membership shall be subject to immediate cancellation and the balance of the contract declared due and payable in full immediately.

  • Member understands that the club prohibits the use of any drug or steroids and member agrees not to use any drugs or steroids on the club premises. Member acknowledges and is aware that steroid can cause numerous physical, mental, and emotional problems relating to physical maturity and growth and may cause heart disease, strokes liver, dysfunction, sterility and infertility and many other adverse health problems. Member recognizes and acknowledges that there are serious criminal and civil penalties for the illegal possession, sale use trading or exchange of steroids and agrees not to participate in any such activity upon club premises or while engaging in club activates.

  • Members agree that if member fails to use the club facilities member remains obligated to make all payment required by the terms of this membership agreement

  • Arbitration: All disputes (except claims under $1,000) will be settled by finding arbitration before a single arbitrator under the authority of the Federal Arbitration Act conduced by and in accordance with the rules and procedures of the American Arbitration Association. The arbitrator will take place in the county in which this club is located unless otherwise agreed. The decision of the arbitrator will be final and binding on all parties and my be enforced by a judgment entered upon the arbitration award by any state or federal court in this state

  • Should this agreement be placed in the hands of an attorney for potential or actual prosecution of a violation of any provision contained herein, the parties agree the club shall be entitled to recover all cost and expenses resulting there from including a reasonable amount of attorney’s fees.

  • The parties hereby agree that the whole agreement between the parties relating to the subject matter herein is contained in this agreement and this agreement shall supersede any prior understanding commitments or undertakings of the parties whether written or oral express or implied.

  • This agreement may not be amended or modified except by an instrument in writing executed by the parties hereto.

  • Member authorizes the club, The Fitness Edge to contact them by e-mail or telephone

  • The club retains the right to modify any of it policies without warning. Reasonable rules and regulations may be posted in the Membership Guild or at the Club form time to time and all members shall be subject to strict compliance therewith. The most current copy of the membership Guild can be found a the club or a the clubs website

Safety Notices

  • This Facility is under 24 hour recorded video surveillance and member access card usage is logged and member consents to such surveillance

  • Members may not bring in guests at any time without the prior written consent of the facility staff employed by the club. In the event that this policy is violated at the sole discretion of the facility management,  member may be charged a guest fee and or have their membership suspended or canceled, the balance of the contract declared due and payable in full immediately and be assessed a penalty of up to  $250.00. Members may not allow anyone else to use their access card and must alert the club immediately if their card is lost or stolen. Violating this policy carries the same penalties as violating the guest policy.

  • Members who do not have their key access card will not be allowed into the facility during non-staffed nor should they expect for anyone else to let them into the facility.

  • Personal training services provide in this facility may be provide either by employees or by independent contractors operation their own business, Regardless all payment of personal training services are to be made to the Fitness Edge Inc who will pay the trainers as the service are provided

  • All members have access to a free orientation to the facility and the proper use of its equipment. It is member’s responsibility to request this orientation

  • It is each member’s individual responsibility to wipe down the equipment and un-rack the weights they use.

  • Members are hereby required to use any and all safely features of the club equipment. If a member is unsure of how to use any club equipment he or she should obtain instructions from the staff or personal trainers.

  • Members are responsible for understanding how to operate the panic alarms and agree to use them only in case of an emergency

  • Horseplay, vulgar language abuse or the equipment, working our while intoxicated or other inappropriate behavior will not be tolerated and my result in the suspension or cancellation of the offending member’s membership and the balance of the contract being declared due and payable in full immediately.

  • Cell phones are not permitted in the cardio area. Use of photography and or video by members upon the premises of the club is prohibited

  • Age requirements Persons under the age of 18 are not permitted in the club.

     

    Equipment and Facilities Policies

    Our club has many different types of equipment to help you achieve your fitness goals. When you complete your complementary Fitness Orientation with a professional trainer, you will be better understand how each piece of equipment works, and what to if you are unsure of how to work a piece of equipment.  Please initial after each section to demonstrate that you understand the policy

    CARDIOVASCULAR EQUIPMENT

    Treadmills: Treadmills allow you to walk or run in place using a belt driven belt an internal motor.  Before beginning a workout on a treadmill:

    • Make sure the treadmill belt is stationary
    • Make sure to tie your shoes, secure personal stereos and dangling jewelry
    • Straddle the belt before programming your workout or starting the treadmill
    • When finished be sure to let the belt come to a complete stop before dismounting
    • NEVER attempt to mount a treadmill while the belt is running

    BIKES

    Bikes (both upright and recumbent work when you begin to pedal   Before beginning a workout on a bike:

    • Adjust your seat before beginning
    • Use the foot straps to prevent slipping
    • Make sure to tie your shoes, secure personal stereos and dangling jewelry

     

    CROSSTRAINERS

    Cross trainers (both upper and lower body) work when you begin to pedal. Before beginning a workout on a cross trainer:

    • Make sure to tie your shoes, secure personal stereos and dangling jewelry
    • Keep both feet on pedals while using
    • Make sure pedals come to complete stop before dismounting

     

    STRENGTH EQUIPMENT

    All strength equipment is designed to perform a basic movement (e.g. chest press) Adjust the equipment for your size and range of movement. Before beginning a workout with our strength equipment:

    • Adjust the seat to your appropriate level
    • Adjust the weights to your appropriate level
    • Secure all loose clothing, personal stereos and dangling jewelry
    • Abide by all posted cautions and warning on the equipment
    • Keep hands and feet away from weight stacks, moving parts and cables while in motion. Use appropriate hand and foot grips
    • NEVER sacrifice proper form to lift more weight
    • Never use equipment that appears to be malfunctioning
    • Do not try to adjust or modify the equipment with add ional weights cables or the like

     

    FREE WEIGHTS

    Free weights are designed to give you total range of motion in a movement.  Free weights include dumbbells. Barbells weight plates and racks. Before beginning a workout with our free weights;

    • Secure all loose clothing personal stereos and dangling jewelry
    • Adjust the weights to your appropriate level
    • Abide by all posted cautions and warning on the equipment
    • NEVER sacrifice proper form to lift more weight
    • Never use equipment that appears to be malfunctioning
    • Always lift with a spotter
    • Never drop or throw weights when finished. Weights on the floor present a tripping hazard

     

    SECURITY

    The club is under 24 hour surveillance. Whether you are working out, entering/leaving the building/restrooms your activities are recorded. This video system is used for security purposes. The surveillance system does not protect you from harm in or on the building premises. You must use caution when entering or leaving the building. Do not allow access to individuals who knock on the door, doing so may put you at risk of injury or harm and could result in you losing your membership privileges. The Fitness Edge will monitor a live stream from its Meredith location and record each day’s activities.

     

    RESTROOMS AND SHOWERS

    The restroom has a bolt lock that should be used when you enter the restroom. The shower has a bolt lock that should be used when you enter the shower room. Please use caution when entering using or leaving these areas as wet floors may cause slippage

     

    SEVERE WEATHER

    In case of severe weather please follow the club’s posted or stated emergency plan

     

    INJURY AND FIRST AID

    In the event that you or another individual becomes injured:

    • For minor injuries (cuts abrasions, etc.) a first aid kit is located on the workout floor
    • For serious injuries that need medical treatment dial 911
    • Report all injuries to the club by call the number posted in the club

     

    POWER OUTAGE

    The door to the club has a fail safe which will allow you to exit the club without power to the door strike. There are also emergency exit lights allowing you to see in case of a power outage

     

    FIRE

    In the event of a fire or if you smell or see smoke, exit the building immediately Call 911 immediately form a cell phone or business nearby.

     

    MISCELLANEOUS

    The foregoing is only a general description of club policies you must follow any other instructions provided to you by the trainer or by any other staff member or posted signage. If you have any questions or concerns on how to use the equipment please ask a trainer or a staff member if available or call the number posted in the club. You must not use the equipment if you are not sure how to use it or if you have any other concerns
